RIM being sued by BBM Canada for illegal use of the trademark

Just a few weeks ago we saw RIM lose a battle over the BBX trademark that they planned to use for the next generation of BlackBerry Smartphones. Now they are facing yet another legal suit regarding their illegal use of another trademarked phrase. It wasn’t until recently that RIM began officially shortening BlackBerry Messenger down to BBM. When that happened, another company out of Toronto, Canada, BBM Canada, took to the courts to get their name back.
Jim MacLeod, BBM Canada’s President and CEO, explained it like this: “We want our name back. I find it kind of amazing that this wouldn’t have been thought about before they decided to use the name. The same thing goes for BBX.” Apparently this company has been around since 1944 and has held the trademark on BBM for quite some time. Sources also cite that when RIM looked into shortening BlackBerry Messenger down to BBM, they were advised by the Canadian Intellectual Property Office that the trademark was already in use and “was not registrable.”
This makes makes RIM’s situation look even worse to the casual observer. RIM has illegally used not one, but two, registered trademarks in this past year. Hopefully the damages that BBM Canada are seeking in this suit won’t be too high and RIM can quickly and easily remove the BBM nomenclature from their site and transition back to BlackBerry Messenger. One interesting fact to note here is that RIM does happen to own the BBM trademark in America, meaning that they could remove the use of BBM in Canada but leave it for American sites and devices. We will all be sitting tight and waiting to see how this one plays out in court. We have reached to RIM and will let you know if and when we receive a statement from them.
